Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Sendable, operated by GYOGYO ("Sendable", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Sendable is a software-as-a-service platform that helps you automate and manage LinkedIn outreach across one or more LinkedIn accounts ("senders"). The Service is provided on a subscription basis.

2. Eligibility and account

You must be at least 18 years old and able to enter into a binding contract. You are responsible for keeping your credentials confidential and for all activity that occurs under your account.

3. Free trial

We offer a 7-day free trial. At the end of the trial, your subscription starts automatically using the payment method on file. You can cancel at any time before the trial ends without being charged.

4. Subscriptions, billing and refunds

• Plans are billed monthly or annually based on the number of LinkedIn senders or the flat plan, as displayed at checkout.
• Subscriptions renew automatically until cancelled. You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period.
• All fees are exclusive of taxes, which will be added where applicable.
• Payments are processed by Stripe. We do not store your full card details.
• Except where required by law, payments are non-refundable.

5. Acceptable use

You agree not to:

• Use the Service in violation of any law, regulation, or third-party rights.
• Use the Service to send spam, harass others, or distribute malicious or deceptive content.
• Attempt to bypass LinkedIn's technical limits, terms or rate limits beyond what the Service is designed to do.
• Reverse-engineer, decompile or attempt to extract the source code of the Service.
• Resell, sublicense or share your account with anyone outside your team without our written consent.

We may suspend or terminate accounts that violate these rules, with or without notice.

6. LinkedIn accounts and third-party services

Sendable interacts with LinkedIn on your behalf. LinkedIn is a third-party service we do not control. You are responsible for complying with LinkedIn's own terms and for any consequences (including account restrictions) that may result from your use of automated outreach. The Service uses safety limits but cannot guarantee that LinkedIn will never restrict an account.

7. Your content

You retain ownership of all content you upload to the Service (campaigns, message templates, lead lists, etc.). You grant us a worldwide, royalty-free licence to host, copy and process this content solely to provide and improve the Service.

8. Our intellectual property

The Service, including its software, design and trademarks, is owned by GYOGYO and protected by intellectual property laws. We grant you a non-exclusive, non-transferable right to use the Service during the term of your subscription.

9. Confidentiality

Each party agrees to keep confidential any non-public information disclosed by the other party and to use it only to perform its obligations under these Terms.

10. Service availability

We aim to keep the Service available 24/7 but cannot guarantee uninterrupted access. We may perform maintenance, updates or temporary suspensions when necessary.

11. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, Sendable will not be liable for any indirect, incidental, consequential or punitive damages, or for loss of profits, revenue, data or goodwill. Our total liability arising out of or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.

13. Termination

You may stop using the Service and cancel your subscription at any time. We may terminate or suspend your access if you breach these Terms or fail to pay. On termination, your right to use the Service ends immediately. We may delete your data after 90 days, except where retention is required by law.

14. Modifications

We may update these Terms from time to time. If changes are material, we will notify you by email or through the Service at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing law and jurisdiction

These Terms are governed by French law. Any dispute relating to the Service or these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Poitiers, France, except where mandatory consumer law provides otherwise.
